K-1 Fiance Visa
The K-1 fiance visa is available to a non-U.S. citizen
fiance wishing to enter the United States with the intention
of marrying a U.S. citizen within 90 days of entering
the country. The process involves the filing of form
129-f with the INS service center of the U.S. citizen
fiance/petitioner's district. Once the 129-f is approved
by the INS, it is forwarded to the non-U.S. citizen fiance's
consulate abroad for further processing. After the marriage,
the second step in the process takes place, adjustment
of status. There are many favorable reasons for obtaining
the K-1 visa.
Any minor children who will accompany the alien fiance
to the U.S. may be eligible for a K-2 visa.
For situations in which the couple is already married
and an alien spouse resides outside of the U.S. and wishes
to enter the U.S., the non-citizen spouse of a U.S. citizen
may be issued a K-3 visa. Any minor children who will
accompany the spouse to the U.S. may be issued a K-4 visa.
The K-3 visa allows a family to reside together in the
U.S. during the lengthy family-based immigration (green
card) process.

V Visa
This new category of nonimmigrant visa may be issued to
certain spouses of lawful permanent residents, their dependent
children (V1, V2, V3) and to spouses of U.S. citizens
who were married overseas and the dependent children of
the alien spouse (K3, K4). Those issued any of these visas
may enter the United States as nonimmigrants to complete
the process of immigration in the United States. Previously,
the spouse and dependent children had to wait outside
of the U.S. until the immigrant visa was issued.
